Supreme Court in Olomouc, Thursday, January 20, 2005, 9.00 AM, The absurd post-Communist kangaroo court with Capt. Vladimír Hučín goes on…?!

The persistent greasy relics of old times and structures in justice, police and attorney’s offices in the Czech Republic take the liberty of inviting you once again to another episode of the absurd lawsuit with Captain Vladimír Hučín – for your money! Their faithful and dependent henchmen will once again demonstrate, for a fat reward, their frolics and “capabilities”. You will be witnessing an absurd theatrical performance the first act of which occurred some 28 years ago, which has already had some 50 episodes, and the end is still far away! The alleged “criminal act” of illegal arming falls under Act No. 198/93 Coll., on the illegal nature of the Communist regime and on resistance against it. It is on the grounds of this law that the alleged “criminal act” of Vladimír Hučín has been proclaimed rehabilitated. Recently, even Mgr. Žaneta Steinbachová, in spite of her bias (which can be proven by her statements during the proceedings), was forced to issue a ruling in favor of Captain Vladimír Hučín!

The very fact that the Office of Public Attorney was able to appeal a rehabilitation ruling based on the legal act referred to above is an outrage. One can hardly believe in consistency of the law. Another example of outrage is the appointment of JUDr. Jaroslav Hudeček, ex-Communist and member of military justice, the Chairman of the Senate of the Supreme Court! If the “criminal act” had taken place in the 1950s, Captain Vladimír Hučín would certainly have been among those awarded a medal in the Prague Castle!

Judge JUDr. Pavel Beneš already rehabilitated Captain Vladimír Hučín twice – on March 22, 1996, and September 27, 1996 – on the grounds of the abovementioned law on the illegal nature of the Communist regime and on resistance against it.

In his ruling of March 22, 1996, Judge JUDr. Pavel Beneš stated, for example: “The activities of Vladimír Hučín at that time must be viewed as acts aimed to protect fundamental human rights and liberties, and it must be noted that Vladimír Hučín’s civic courage is undeniable.” However, the verdict was challenged by District Attorney Mgr.Radim Obst and JUDr.Karel Studený – both with provable close links to former top officers of the State Security Office in Přerov (evidence to this effect is in the classified court file). Judge JUDr.Pavel Beneš had to reopen the proceedings, and once again, on September 27, 1996, issued a ruling in favor of Vladimír Hučín’s rehabilitation in accordance with Act No. 198/93 Coll. The District Attorney’s Office in Přerov challenged the ruling again, and it’s been going on like this until now! Judge JUDr. Pavel Beneš now holds a far less important post at the District Court in Přerov…?!

Who will be held responsible for the violation of laws and criminal waste of taxpayers’ money in the affair aimed against the latter’s interests?!

The testimony of Captain Vladimír Hučín now poses a direct threat to the position of many powerful individuals in justice, police and security forces, who have retained their posts since the Communist times and now are defending them by all means, including illegal ones. One can hardly be surprised. They have no other option. It’s their collective “neck”, well fed by taxpayers’ money, which is on the block.

In this particular case, the Attorney’s Offices obviously doesn’t serve the state or protect its interests; it serves and protects the interests of old structures in security forces. They basically violate the law, constitution and the oath of loyalty to the republic. They are abusing their status of the public official, for which they should be held accountable.

As the Chairman of the Petition Committee established to support Captain Vladimír Hučín, I am hereby calling upon the following public officials and legislators, who should have attended the court proceedings long ago in the first place, to take part in the above court proceedings in Olomouc, as the matter at hand directly concerns their offices, their responsibilities or themselves. However, it concerns most the security situation in the Czech Republic. They are: Pavel Němec – Minister of Justice, Pavel Rychetský – Chairman of the Constitutional Court, Svatopluk Karásek – Government’s Commissioner for Human Rights, Otakar Motejl – Ombudsman, Stanislav Gross – Prime Minister, Cyril Svoboda – Minister of Foreign Affairs, František Bublan – Minister of Interior, Jiří Kolář – Police President, Jan Princ – Director of BIS Regional Office, Olomouc, Jiří Lang – Director of BIS, Jan Klas – Chairman of the BIS Committee of the House of Deputies of the Parliament of the Czech Republic, Ivan Langer – Deputy Speaker of the House of Deputies and shadow Minister of Interior of ODS, Lubomír Zaorálek – Speaker of the House of Deputies, Přemysl Sobotka – Speaker of the Senate, as well as all other deputies and senators, who are aware of their duties and responsibilities.

Will the leaders of the Confederation of Political Prisoners and the CPP president, MUDr. Naďa Kavalírová, turn up at last and offer public support to one of their members?! Will ex-President Václav Havel, whom I personally gave updated documents on the Hučín case not so very long time ago and who had had an opportunity to study the file in 2001? I believe he will. He has been a champion of human rights all over the world for a long time, why wouldn’t he show his efforts are genuine by attending the court proceedings, and assist in the struggle for human rights and rule of law in his home country through his personal involvement?

I am also calling upon media, radio, TV and press journalists, both from our country and from abroad. This case should concern us all and the truth, supported by documents in respect whereof there doesn’t exist the slightest vestige of reason why they should be published, must be finally presented to the world to see, in the interest of the Czech Republic, European Union and security and in support of the return of justice, legal state and good morals.

I believe that citizens will come in their hundreds this time. Justice Guards and police will certainly waste no time to ensure safety and security for everybody – and spending hundreds of thousands of korunas of taxpayers’ money in the process!

Come and see the absence of morals, havoc and chaos in the Czech justice, come and see for yourself. You have to see it for yourself to believe. Those who will come will certainly see and hear something!

Not so very long time ago, members of the Swedish Socialist Democratic Party urged their Prime Minister not to cooperate, ever, with Communists. They used the following words: “Communism is not any noble concept, which could be separated from totalitarian practice. Communism is a coherent system of ideas, attitudes and norms, which place the “system” and “party interests” before the individual and democracy. This is how it used to be and this is how it is now.”

The Swedish daily Dagens Nyheter adds a quotation by Karel Čapek from “Why I am not a Communist“ (1924): “The last word of Communism is to rule, not to save.” The famous Czech writer is a good teacher, say the Swedes. What about that, Mr. Gross and Mr. Škromach? Will you come to Olomouc?! statements during the proceedings), was forced to issue a ruling in favor of Captain Vladimír Hučín!
